Akami/McKesson Decision Re-defines Induced Infringement ...

In a 6-5 decision, the Fed. Cir., sitting en banc, decided two appeals which presented questions closely related to when an actor is liable for inducing infringement under 271(b); Akami Technologies, Inc. v. Limelight Networks, Inc. and McKesson Tech?s., Inc. v. Epic Systems Corp., App. No. 2010-1291 (Fed. Cir. August 31, 2012).

The claims at issue were both multi-step method claims.? McKesson?s patent claimed a software application that it argued Epic indirectly infringed when it caused patients to initiate communications providing ?My Chart? healthcare information to which the providers would respond. Epic did not perform any of the claimed steps. I won?t discuss the Akami facts, since they are less closely related to life sciences.

The court framed the question as limited to the type of infringing acts that would impart liability for induced infringement under 271 (b) and did not purport to redefine direct infringement under 271(a). The court framed the questions to be resolved as:

?[W]hether a defendant may be held liable for induced infringement if the defendant has performed some of the steps of the claimed method and has induced other parties to commit the remaining steps [as in Akami], or if the defendant has induced other parties to collectively perform all of the steps of the claimed method, but no single party has performed all of the steps itself [as in McKesson].?

The court answered ?Yes? to both questions:

?To be clear, we hold that all the steps of a claimed method must be performed in order to find induced infringement, but that it is not necessary to prove that all the steps were committed by a single entity.? Slip. op. at 10.

The court expressly overruled BMC Resources, Inc. v Paymentech, L.P., 498 F.3d 1373 (Fed. Cir. 2007) that had held that, in order for a party to be liable for induced infringement, some other single entity must be liable for direct infringement ? e.g., must be directed or controlled in some cases by the inducer, or even be the inducer?s legal ?agent.? Under Akami/McKesson : ?It is enough that the inducer ?cause[s], urge[s], encourage[s] or aid[s]? the infringing conduct and that the induced conduct is carried out.? Slip op. at 15. But remember, the level of encouragement must still rise to the level of specific intent that infringement occur. Slip. op. at 14.

After thirty plus pages of analysis of legislative history and analogous legal doctrines, the court states:

?At the end of the day, we are persuaded that Congress did not intend to create a regime in which parties could knowingly sidestep infringement liability simply by arranging to divide the steps of a method claim between them.? Slip op. at 35.

This decision will surely lead to a cert. petition by the defendants and, since I have not read the many pages of dissent, I am not going to try to predict the ultimate outcome. However, if diagnostic method claims of some sort are still patent-eligible, this decision would seem to increase their value.

A method claim could recite the steps necessary to arrive at a diagnosis, providing the diagnosis to the patient or his/her?internist and beginning the course of treatment by a specialist, and still be infringed by a third party who labels the [off-patent]diagnostic agent?in a way that informs the internist to order the diagnostic test using it, tell the patient the results and refer the patient for treatment. The third party may have received the necessary approvals for its version ? or copy ? of the agent, but not carry out a single step of the patent claim.

Consider that the brevity of the Prometheus and the Myriad method claims certainly contributed to their ?downfall.? Akami/McKesson gives practitioners a license, if not to ?kill? infringers, at least to search for that intangible ?more? that will show the courts the ?hand of man? at work?converting those pesky natural phenomena and abstract ideas into claimable solutions for real world healthcare crises.

Larry Flynt offering $1 million for Romney financial records

Hustler magazine founder Larry Flynt (wikicommons)Hustler magazine publisher, and self-described free speech activist, Larry Flynt is offering $1 million for anyone who will provide him with Mitt Romney's financial records.

Flynt, 69, has purchased full-page ads in Sunday's Washington Post and Tuesday's, September 11 issue of USA Today.

"What is he hiding?" the ad text reads, "Maybe, now, we'll find out." The ad also includes a phone number and email address where anyone with information can contact Flynt.

A press release credited to Hustler says Flynt is "offering up to a million dollars in cash for documented evidence concerning Republican Presidential candidate Mitt Romney's unreleased tax returns and/or details of his offshore assets, bank accounts and business partnerships."

Romney has only agreed to release his 2010 and 2011 tax returns so far.

On Friday, the Secret Service and FBI announced they are investigating an anonymous letter from an individual claiming to have stolen copies of Romney's tax returns. The letter reportedly demands $1 million in hard to trace Internet funds. Romney's accounting firm, PricewaterhouseCoopers, has denied that any records were stolen.

Flynt, a registered Democrat who once ran for president as a Republican, is no stranger to politics. And he's certainly no stranger to offering $1 million rewards for his various political interests. He's made similar offers against everything including a request to debunk the Warren Commission's investigation into the death of John F. Kennedy to most recently asking for evidence supporting his belief that Texas Governor Rick Perry was guilty of infidelity.

Back during the impeachment trial of then-President Bill Clinton, Flynt made a $1 million offer for evidence of marital infidelity against Republican members of the House who were leading the trial against Clinton. That offer led to incoming House Speaker Bob Livingston resigning after evidence of his own affair was publicly revealed.

In 2007, Flynt offered a financial reward for evidence showing that Louisiana Republican Senator David Vitter had cheated on his wife. Vitter has remained in office, even after the evidence was made public.

Back in 2003, Flynt was one of several atypical candidates to run in the California gubernatorial recall election to replace Democrat Gray Davis.

Flynt has also run into some political troubles of his own recently. In August, California's Fair Political Practices Commission accused him of failing to report campaign donations in a timely manner that Flynt made to a state assembly candidate. However, Flynt was not fined by the agency since he filed his report immediately after the complaint was issued.

Taylor Swift Will Debut Song For Cancer Victim At 'Stand Up To ...

Tonight (Sep. 7) several networks will be airing the third annual Stand Up To Cancer Telethon, a star-studded special raising awareness and money for cancer research. Celebrities like Tom Hanks, Gwyneth Paltrow and Justin Timberlake will take part, while Alicia Keys, Coldplay, and Taylor Swift are scheduled to perform. Swift is expected to debut her song ?Ronan,? which she wrote about a 3-year-old boy of the same name who died of neuroblastoma in 2011. Swift penned the song after reading a blog post by Ronan?s mother Maya Thompson, and credited her as a co-writer. The track will be available on iTunes tonight and sales will go to cancer-related charities.

You can watch the telethon at 8 p.m. ET on ABC, CBS, FOX and NBC.

20 Best Android apps this week

It's time for our weekly roundup of the best new Android apps for smartphones and tablets, drawn from a mixture of Google Play digging, press releases and submissions from developers.

Games aren't included ? they get a separate roundup which has plenty of Android games this week. The weekly iOS apps roundup will be published later in the day.

Here's this week's Android selection:

Fancy a pizza? UK chain Pizza Express' innovative app has been ported from iOS to Android, enabling customers to book tables, and then pay for their bill using PayPal at the end of their meals. The app will also provide regular offer codes, and it ties in with the chain's Click & Collect takeaway-ordering service too.

Pitching itself as a "social storyboard", Via.me is an app for sharing photos, videos, audio and text on a standalone social network, as well as through Facebook and Twitter. That means photo filters, feeds of friends' activity ??assuming they're on it, of course ??and notifications aplenty.

The official White House app has been out for a little while, but what's new this week is a version for Android tablets, just as the US presidential election gets into swing. Expect news, photos and videos from the White House, including live video streams of events featuring the president himself, and his officials.

Lots of people in Silicon Valley have been getting excited about Q&A service Quora for a while now, thanks to plenty of tech executives giving candid views on their industry. Can it become more mainstream through mobile apps? The new Android version is a step in that direction, providing a usable window into Quora, and lots of Android-specific widgetry and features.

Out on iOS a couple of weeks ago, WHSmith's official app for this year's Richard and Judy Book Club initiative is the latest example of branded augmented reality. Using HP subsidiary Aurasma's AR technology, it encourages readers to scan covers of participating books to watch reviews and other videos.

Possibly controversial, this, but on the basis that it's a significant new release ??and that there are a number of non-copyright-infringing uses for it ???Torrent makes our selection this week. It's a beta Android client for one of BitTorrent's two clients (the other, BitTorrent itself, already has an Android beta). For now it's free, and aims to make it easy to find and download torrents, including RSS feed subscriptions.

This sounds like it should be some kind of social TV / second-screen app, but actually it's more of a social videos play, taking on Socialcam and Viddy. The idea: shoot videos, add music, and then share on Facebook and Twitter, as well as through Telly's own standalone social network. It's the work of Twitvid, which was one of the first social video startups.

This app is the latest attempt to make Android smartphones safe for children (see also: Famigo Sandbox). The idea is that parents install the app on their child's phone, and can then monitor what they're doing in terms of apps, social networking and calls. It also has "check-ins messages" to make it quicker for children to let their parents know their current location. A bit Big Brother? That's a debate worth having. If a child is old enough to be given an Android smartphone, are they also old enough to not have their usage of it monitored this closely?

Stuxbot Technology's new Android app wants to be "a guide for a less able lifestyle". That means a location-based guide to restaurants, bars, cafes and so on, but with an emphasis on how accessible they are (for example: wheelchairs). The app can also be used to call venues for bookings, or browse their websites, and it recommends nearby places with reviews.

"Prepare yourself for a happy mouth explosion," shouts Gojee's Android app description, by way of introduction (in capitals). It's an app aggregating food and drink recipes from more than 200 foody blogs, and presenting them with lip-smacking photography in a slinky user interface.

Samsung has bagged an initial exclusive on the official Android app from fashion house Zara. On offer is the company's catalogue, refreshed every week, with options to buy clothes, and scan barcodes when in a store for more information and alternative colours.

There's a mini-blitz of social travel apps in 2012, as startups scramble to help travellers connect to friends and strangers alike for better information on destinations. Tripayo's new app is, as its name makes clear, about hooking up with fellow travellers while on your jaunts ??presumably for friendship or more, depending on the situation. Hotel and flight-bookings features are also included.

Indian online radio service Radiowalla has launched its official Android app, offering its hand-picked selection of streaming stations in music, sports and talk genres. Some shows can be listened to on-demand, too.

Hollywood industry magazine The Hollywood Reporter has taken its app to Android, offering a feed of news, views and videos from the film, TV and music industries. Social features are also built in.

TechSmith's Coach's Eye app is a very clever tool for athletes (pro or otherwise) and coaches. The idea: "video capture with slow-motion review, drawing tools, and simple sharing" to analyse your performance and learn to do things better, whether that's running, throwing or swinging a golf club.

Another app that does what it says on the title. EnsightMedia's app offers 50,000 streaming radio stations drawn from Shoutcast's radio directory, with search features, a sleep timer and some skeuomorphic design touches to make it look like a vintage radio.

Android is already one of the more customisable smartphone operating systems, through its own widgets and third-party apps. Foneclay is the latest example of the latter, promising "immersive, art-interfaces as dynamic as you are". Including, as you'll see from its Google Play screenshots, big yellow monsters. It's a more fun take on the phone-customisation apps genre.

If I had a pound for every alarm-clock app I've seen go live on Google Play, I'd be too busy browsing speedboat catalogues to write this roundup. Sadly, most of them are rubbish. Sleep Time ??Alarm Clock is one of the better ones though: a "sleep cycle alarm clock" that aims to detect your movements in bed using your device's accelerometer, then wake you up at the right moment to avoid grogginess.

Some fun here, of the augmented-reality-t-shirt-to-make-an-alien-burst-out-of-your-chest variety. Scan one of Fingerfunk's t-shirts and, yes, an alien will burst out of the person's chest. A novelty, yes, but a useful showcase for what's possible with technology like the Unity 3D game engine and Qualcomm's Vuforia AR platform (both used here).

And a bit more fun to finish off, although "finish off" is perhaps not the best phrase to use in this context. Vibease promises "soothing ambient sound and customizable vibration rhythm", as well as a private social network for couples to... Well, make one another's smartphones buzz. The app will also work with a separate Vibease vibrator for true Android-fuelled sexytime. Not a phrase you'll be reading in this column for a while, thankfully.

Who?s the most influential in a social graph? New software recognizes key influencers faster than ever

ScienceDaily (Sep. 7, 2012) ? At an airport, many people are essential for planes to take off. Gate staffs, refueling crews, flight attendants and pilots are in constant communication with each other as they perform required tasks. But it's the air traffic controller who talks with every plane, coordinating departures and runways. Communication must run through her in order for an airport to run smoothly and safely.

In computational terms, the air traffic controller is the "betweenness centrality," the most connected person in the system. In this example, finding the key influencer is easy because each departure process is nearly the same.

Determining the most influential person on a social media network (or, in computer terms, a graph) is more complex. Thousands of users are interacting about a single subject at the same time. New people (known computationally as edges) are constantly joining the streaming conversation.

Georgia Tech has developed a new algorithm that quickly determines betweenness centrality for streaming graphs. The algorithm can identify influencers as information changes within a network. The first-of-its-kind streaming tool was presented this week by Computational Science and Engineering Ph.D. candidate Oded Green at the Social Computing Conference in Amsterdam.

"Unlike existing algorithms, our system doesn't restart the computational process from scratch each time a new edge is inserted into a graph," said College of Computing Professor David Bader, the project's leader. "Rather than starting over, our algorithm stores the graph's prior centrality data and only does the bare minimal computations affected by the inserted edges."

In some cases, betweenness centrality can be computed more than 100 times faster using the Georgia Tech software. The open source software will soon be available to businesses.

Bader, the Institute's executive director for high performance computing, says the technology has wide-ranging applications. For instance, advertisers could use the software to identify which celebrities are most influential on Twitter or Facebook, or both, during product launches.

"Despite a fragmented social media landscape, data analysts would be able to use the algorithm to look at each social media network and mark inferences about a single influencer across these different platforms," said Bader.

As another example, the algorithm could be used for traffic patterns during a wreck or traffic jam. Transportation officials could quickly determine the best new routes based on gradual side-street congestion.

The accepted paper was co-authored by Electrical and Computer Engineering Ph.D. candidate Rob McColl.
